Allison Millspaugh, sole proprietor of ACM Fitness LLC ("ACM Fitness", "we" or "us"), is the absolute owner of the mobile application "ACM Fitness" (the “App”). The App enables personal trainers, wellness coaches and nutritionists to provide training and coaching to their clients using the App. ACM Fitness has the sole right to develop, make improvements and update the App. The App is developed and maintained by FitBudd Inc. including any of its subsidiaries (“FitBudd”).
ACM Fitness attaches high importance to the privacy and protection of our User’s personal data and information. This Privacy Policy explains our practices related to the collection and use of personal data and has been provided for your reference. We have implemented reasonable security practices and procedures commensurate with the information assets being protected and the nature of our business.
While we make efforts to provide appropriate security, there are inherent risks with internet transmission that are beyond our control. By using our App and Services, you agree that we shall not be responsible for any unauthorized access or breach of your personal data. This Privacy Policy should be read along with the Terms of Use before using our App or Services.

If you register as a user on the App, you will be asked to create a unique username and password to set up an account and access the App (“User Account”). Certain personal information like your name, age, gender, health information and email address may be required to provide you access to the App and Services. Photos may also be uploaded to the App to track fitness progress.
ACM Fitness will store all Personal Information in compliance with applicable laws and make best efforts to protect the privacy of photos uploaded. However, ACM Fitness shall not be liable for any unauthorized disclosure by registered trainers, coaches or nutritionists.
The trainers, coaches and nutritionists may also upload videos and images to provide Services to Users. ACM Fitness shall not be responsible for the source, nature or content of such materials. ACM Fitness will not be liable for any third party copyright infringement or plagiarism claims.
Financial account information like bank account numbers may be collected through the App only as described in the Terms of Use. You may contact us to update any Personal or Financial Information. You may also request that we stop retaining or using your Personal or Financial Information, however this may impact our ability to provide you Services and access to the App.
We may use your contact information to send Service-related communications without further notice. We collect certain usage data and information about your device to deliver, track and improve our Services. Any location information provided helps us offer localized features, marketing and improvements.
3. Purpose of Information Collection
We will collect, store and use your Personal and Financial Information only to provide access to the App and Services, unless you opt-out of non-essential communications. We may use your information to:
- Advise you on client progress, updated plans, promotions
- Understand user needs and improve our Services
- Detect and protect against fraud or unlawful activity

- As otherwise disclosed at the time of collection

You may not violate the security of the App by:
- Attempting to breach security measures or test vulnerability
- Attempting to interfere with or disrupt App services
- Distributing spam, malware or other harmful content
Violations may result in civil/criminal liability. We may investigate occurrences and cooperate with authorities as applicable. You may not use any device, software or routine to interfere with the proper working of the App.

We may send you service-related emails and newsletters. You can opt out of non-essential communications by emailing us or using the unsubscribe link provided.

While we do not voluntarily share your personal data, we may disclose it if required by a court order, law or governmental authority, or to protect our rights, users, and the public.
